Terms & Conditions

 

1. Scope

These Terms and Conditions apply to all orders placed through this online store operated by Plamen Bibeschkov, Germany.

They apply to both consumers and business customers unless otherwise stated.

2. Conclusion of Contract

The presentation of artworks on this website does not constitute a legally binding offer but an invitation to place an order.

By placing an order, the customer submits a binding offer to purchase the selected artwork.

A contract is concluded only when we accept the order by sending an order confirmation email.

3. Prices and VAT

All prices are stated in Euro (€) and include applicable value added tax (VAT), unless otherwise indicated.

Shipping costs (if applicable) are displayed separately at checkout.

For international orders outside the European Union, import duties and taxes may apply and are the responsibility of the buyer.

4. Payment

Payment methods available are those displayed at checkout.

Payments are processed securely through Shopify Payments and/or third-party providers such as PayPal, credit card providers, or other available services.

We reserve the right to refuse certain payment methods in individual cases.

5. Delivery

Delivery is made from Germany to the address specified by the customer.

Delivery times are indicated in the Shipping Policy.

The risk of accidental loss or damage passes to the consumer upon delivery of the goods.

For business customers, risk passes upon dispatch.

6. Retention of Title

The artwork remains our property until full payment has been received.

7. Right of Withdrawal (Consumers Only)

Consumers have the right to withdraw from the contract within 14 days in accordance with our Return & Cancellation Policy.

The right of withdrawal does not apply to commissioned or custom-made works created specifically at the customer’s request.

8. Condition of Goods and Returns

Returned artworks must be in their original condition and securely packaged.

Customers are responsible for return shipping costs unless otherwise agreed.

9. Liability

We are liable without limitation for intent and gross negligence.

For slight negligence, we are liable only for breaches of essential contractual obligations and limited to foreseeable damages typical for the contract.

These limitations do not apply to liability for injury to life, body, or health.

10. Commissioned Works

Custom or commissioned artworks are created based on individual agreement.

Once production has begun or the final version has been approved, cancellation or return is excluded unless otherwise agreed in writing.

11. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers within the European Union, mandatory statutory consumer protection provisions of the country in which the consumer has their habitual residence shall remain unaffected.

If the customer is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction shall be our registered place of business.
